This is a basic outline of the bankruptcy filing process in Utah.

First, we will have a phone conversation to gain a good understanding of your situation, answer any questions you may have, and decide together which kind of bankruptcy (Chapter 7 or Chapter 13) would best meet your needs. We will discuss our fees and we will send you an email with our questionnaire and list of required documents.

First appointment
After we receive your completed questionnaire and required documents, we will schedule a roughly 60 minute call to go over your case in detail.

Case preparation
After our 60 minute call, we will prepare your official bankruptcy papers to file with the court. We will email them to you for review and e-signature prior to filing.

Trustee meeting
About 30 days after your case is filed with the court, we will attend a video meeting with the bankruptcy trustee. One of our attorneys will call you the night before the meeting to advise you how to answer the questions and tell you what to expect.

If there are any disagreements between your attorney and the bankruptcy trustee about your payment plan, the disagreements will be resolved by the judge at a confirmation hearing.

Months 3-36
During this time, you will send your monthly bankruptcy payments to your trustee, which he/she will then use to pay down your debts. This may, in some cases, be over a 60-month period rather than 36.

You make your last required payment. The judge then signs the discharge order, your trustee signs the case as closed and…you’re done! No more debt!
